These Terms of Service ("Terms") govern your use of the Dude, It's Firing! surf alert service ("Service", "we", "us") as offered to users in Australia. By signing up, you agree to these Terms.
Dude, It's Firing! monitors surf conditions (wave height, period, swell direction, wind, and tide) at surf spots you select, and sends you an SMS or email alert when conditions meet the threshold we've set for that spot. We do not guarantee the accuracy of any alert, and conditions can change quickly between when an alert is sent and when you arrive at the beach.
The Service is offered on an annual subscription basis in Australian Dollars (AUD), at the price tier you select at signup. Subscriptions automatically renew annually unless cancelled before the renewal date. You can cancel at any time via the unsubscribe link included in every message, or by contacting us directly.
Australian Consumer Law: Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) that cannot lawfully be excluded. Where permitted by law, our liability for breach of a non-excludable guarantee is limited, at our option, to re-supply of the Service or the cost of re-supply.
By providing your mobile number and opting in, you consent to receive recurring text message alerts from Dude, It's Firing! Message frequency varies based on real-world surf conditions and is not on a fixed schedule. Standard message and data rates from your carrier may apply. You can opt out at any time by replying STOP or using the unsubscribe link in any message.
Surf and weather forecasting involves inherent uncertainty. Wave, wind, and tide data is sourced from third-party providers and may be delayed, incomplete, or inaccurate. The Service is provided for informational purposes only and should never be your sole basis for entering the water. Always exercise your own judgment and assess conditions in person before surfing.
To the maximum extent permitted by law, and subject to Section 2 above regarding the Australian Consumer Law, Dude, It's Firing! is not liable for any injury, loss, or damage arising from your use of the Service, including reliance on any alert, or from surfing conditions that differ from what was alerted.
We may update, modify, or discontinue features of the Service at any time. We'll make reasonable efforts to notify subscribers of material changes.
